March 8, 2007 LaVida Launch Event
Over 300 guests visited LaVida's newly opened Beach Club for an evening of dining and entertainment. Sixty Real Estate professionals from over 14 offices stopped by to see first hand the development that will soon be recognized as Bucerias' most beautiful and upscale residential beachfront property. Also in attendance was Fernando de Haro, LaVida's architect and author of many architectural coffee table books. Marco Alvarez, one of Vallarta's own local artists was also a guest. He was commissioned provide a large painting for the Beach Club. The event was a success by all measures. Highlights include great food and drinks catered by Eventful Moments Vallarta, a mariachi band, music by the Frixoleros and a fireworks display to cap off the evening.
Spring 2007 – LaVida Partners with CarVal Investors

FINANCIAL DETAILS
With a $25,000 USD deposit, a specific residencia can be reserved for a period of one month from the date when the prospective buyer has received the Purchase and Sale agreement, Condo Regime, Floor plans, and Pricing and Payment terms. This deposit will be held in a Master Escrow Account with First American Title Insurance Company of Miami, Florida. If, after the month, the prospective buyer decides not to purchase, the deposit will be refunded in full. If the prospective buyer decides to move ahead by signing a sales contract, the $25,000 deposit will be applied toward the required down payment and held in an individual Escrow Account in the buyer's name until funds are released to the developer.
Payment Schedule
- 35% upon signing of a sales contract (minus reservation deposit)
- 25% due at 3 months after signing of contract
- 25% due at 6 months after signing of contract
- 15% due at closing.
Closing costs, Notary fees and any Bank Trust fees will be the responsibility of the Buyer. All payments will be made through First American Title and will be released to the developer starting at commencement of construction.
CONSTRUCTION SCHEDULE
Construction is anticipated to be completed Summer 2008
MONTHLY MAINTENENCE FEES
Monthly Maintenance Fees for all non-beachfront homes will be $2.90 USD per square meter of total construction per month. Beachfront residencias will be $3.60 USD per square meter of total construction per month. Note: Maid service and pool cleaning are included in the monthly maintenance fee. (WHAT ELSE IS??)
CONDOMINIUM REGIME
The La Vida Condominium Regime is a Vertical and Horizontal regime, and is available by request at the La Vida Sales Office.
OWNING LAND
THE BANK TRUST
Until 1993, it was not possible for foreigners to hold title to land in Mexico that was within100 kilometers from a border, or 50 kilometers from either coast. In the 1980s, however, it became obvious to the Mexican government that foreign investment in real estate would be an important way to establish a strong and stable economy.
In 1993, then, the Foreign Investment Law was passed whereby foreigners may purchase land in restricted zones provided the deed is held in trust by a trustee. Thus, banks such as Banamex and Bancomer operate as trustees and can hold your deed in trust for you. The banks, which must hold a permit issued by the Mexican Secretary of Foreign Relations, charge an annual fee for this service, generally around $500 USD. The trust agreement is valid for 50 years and must be renewed thereafter for another 50 years within 90 days of the expiration of the first term.
It is through the use of this trust arrangement that compliance with the Mexican Constitution can be maintained: technically you, as a foreigner, do not hold your deed. Instead, it is held in trust for you by a trustee.
Do not confuse this with a 99-year lease. When you buy land in Mexico, you are buying it, not leasing it. You may sell the land at any time, and you may leave it to anyone you choose in your will. If you sell it or bequeath it, the new owner, if a foreigner, must set up a bank trust, just as you did. But in his case, the first 50-year term commences at the time the land is transferred; it does not date from the time you initially purchased the land.
Land may be purchased in more than one name, and in the deed, you will also be asked to name substitute beneficiary(ies) in the event of your death. Also, you should know that when you set up a real estate trust, you must agree to adhere to the laws governing real estate transactions in Mexico, and not those of your own country.
